While every matter is distinct, I have successfully secured dismissals for both felony and misdemeanor DUI charges by challenging the legality of traffic stops and evidence.
Did you know that a bike rack does not count as an "obstruction" of your license plate? Neither did the judge or the prosecutor. But at the conclusion of my client's preliminary examination on his gun and felony DUI case, I objected to the stop as lacking in probable cause. They had to spend a few minutes reading the law, but in the end they agreed and dismissed my client's case.
